Introduced House Bill 4012 Would Legalize Agriculture in Residentially Zoned Areas

Republican Tim Kelly from the 94th District introduced House Bill 4012 yesterday that would amend the Zoning Enabling Act to allow for agriculture in residentially zoned areas.  

(2) THIS SUBSECTION SHALL BE KNOWN AND MAY BE CITED AS THE   "HOMESTEAD SUBSISTENCE FARMING ACT". IF A STRUCTURE IS LAWFULLY USED AS A RESIDENCE UNDER A ZONING ORDINANCE, THE PRODUCTION OF FARM PRODUCTS ON THE PROPERTY WHERE THE STRUCTURE IS LOCATED, FOR CONSUMPTION BY THE RESIDENTS OR TRANSFER BY THE RESIDENTS, IS A LAWFUL USE AND IS NOT SUBJECT TO A SPECIAL USE OR CONDITIONAL USE PERMIT OR PROCEDURE. THIS SUBSECTION DOES NOT PROHIBIT SALES OF FARM PRODUCTS ABOVE A DE MINIMIS VALUE IF OTHERWISE AUTHORIZED BY LAW. AS USED IN THIS SUBSECTION: (A) "FARM PRODUCTS" MEANS FRUITS, VEGETABLES, DAIRY PRODUCTS, OR REASONABLE NUMBERS OF POULTRY, LIVESTOCK, OR OTHER FARM ANIMALS. "TRANSFER" INCLUDES FOOD STAND OR SIMILAR SALES OF A DE MINIMIS VALUE OR TRADING OR SHARING.

It would be fantastic to have 2 or 3 hens as pets that also lay eggs for your family. can you imagine how fresh they would be, and much healthier for children as well. I hope it passes. Finally, some Bill that is really useful!!! Good luck Mr. Kelly!

Read it again - do you REALLY want this: OR REASONABLE NUMBERS OF POULTRY, LIVESTOCK, OR OTHER FARM ANIMALS. Now - I suppose that you do but what about if you're the person living in the city of FARMOPOLIS (fictitious) on your 75' X 125' lot and your next door neighbors (family of 7) find it VERY reasonable to have more than just a few hens - I LOVE bacon and ham .... steaks are good too! Just sayin'... - while I 'personally' believe that urban agriculture needs to thrive, let's do it sensibly and with enough forethought to protect those that do not vision the unintended consequences.
